{"id":18172,"date":"2023-01-27T15:09:00","date_gmt":"2023-01-27T14:09:00","guid":{"rendered":"https:\/\/www.genevacitieshub.org\/?p=18172"},"modified":"2023-01-30T16:22:44","modified_gmt":"2023-01-30T15:22:44","slug":"the-best-way-to-start-implementing-upr-recommendation-is-at-local-level","status":"publish","type":"post","link":"https:\/\/globalcitieshub.org\/es\/the-best-way-to-start-implementing-upr-recommendation-is-at-local-level\/","title":{"rendered":"La mejor manera de empezar a aplicar la recomendaci\u00f3n del EPU es a nivel local"},"content":{"rendered":"<p>El 27 de enero de 2023, el Geneva Cities Hub organiz\u00f3 un acto paralelo al 42<sup>nd<\/sup> sesi\u00f3n del Grupo de Trabajo sobre el Examen Peri\u00f3dico Universal (EPU). Su objetivo era debatir la cuesti\u00f3n de los gobiernos locales y regionales (GLR), los derechos humanos y el EPU, un mecanismo que implica una revisi\u00f3n paritaria de la situaci\u00f3n de los derechos humanos en los 193 Estados miembros de la ONU. Aunque el mecanismo est\u00e1 dirigido por los Estados, tendr\u00eda mucho que ganar si incluyera mejor a los GLR. Eso es lo que se argumenta en el <a href=\"https:\/\/www.genevacitieshub.org\/en\/tips-for-local-and-regional-governments-wishing-to-participate-to-the-universal-periodic-review\/\" target=\"_blank\" rel=\"noreferrer noopener\">Consejos de la UPR para los GLR<\/a>publicado por la Coalition for LRGs in UPR liderada por el GCH, con otros socios (OHCHR, UN Habitat, UPR Info, Friedrich-Ebert-Stiftung y la Geneva Human Rights Platform).<\/p>\n\n\n\n<p>El acto paralelo se celebr\u00f3 justo despu\u00e9s del EPU de Suiza y el Embajador suizo ante la ONU en Ginebra <strong>J\u00fcrg Lauber,<\/strong> subray\u00f3 que \"<em>muchas de las recomendaciones formuladas durante nuestra revisi\u00f3n est\u00e1n directamente relacionadas con los servicios prestados por los municipios, por lo que deber\u00e1n aplicarse a nivel local<\/em>\". Debido a su sistema federal, los cantones suizos han participado estrechamente en el proceso del EPU, pero ser\u00eda un reto a\u00f1adir a los municipios al proceso de consulta nacional del EPU. Sin embargo, el embajador Lauber tambi\u00e9n dijo que deber\u00eda buscarse una coordinaci\u00f3n m\u00e1s estrecha en muchos temas (desde la acogida de migrantes y refugiados en las ciudades hasta la lucha contra el cambio clim\u00e1tico y las medidas contra la discriminaci\u00f3n y la violencia dom\u00e9stica). A partir de ahora debe buscarse una coordinaci\u00f3n m\u00e1s estrecha hasta que Suiza adopte una posici\u00f3n sobre cada una de las recomendaciones formuladas, pero tambi\u00e9n para debatir los medios y formas de aplicaci\u00f3n de las recomendaciones aceptadas, dijo <strong>Gianni Magazzeni.<\/strong><\/p>\n\n\n\n<p><strong>Christof Meier,<\/strong> en representaci\u00f3n del alcalde de la ciudad de Zurich, se refiri\u00f3 a una cuesti\u00f3n que no figura en el informe nacional suizo para el EPU: <a href=\"https:\/\/www.stadt-zuerich.ch\/prd\/en\/index\/urban-development\/integration-office\/sans-papiers.html\" target=\"_blank\" rel=\"noreferrer noopener\">la situaci\u00f3n de los inmigrantes indocumentados<\/a>. Insiste en que las ciudades no tienen otra opci\u00f3n que ocuparse de los inmigrantes indocumentados, que est\u00e1n all\u00ed, en la ciudad. Aunque ninguna legislaci\u00f3n nacional reconoce derechos a los sin papeles, la legislaci\u00f3n internacional sobre derechos humanos s\u00ed lo hace. Por eso es importante proporcionar a los inmigrantes en situaci\u00f3n irregular tantos servicios p\u00fablicos como sea posible (educaci\u00f3n, sanidad, etc.). Una de las cuestiones m\u00e1s importantes, que no est\u00e1 en manos de la ciudad, es el acceso a la justicia. En este punto, Christof Meier se refiri\u00f3 a la falta de acceso a la justicia de los inmigrantes en situaci\u00f3n irregular. Ninguno puede denunciar ning\u00fan abuso ni testificar, debido a su condici\u00f3n de indocumentados, lo que constituye un verdadero problema para el que la ciudad no ha encontrado ninguna soluci\u00f3n hasta la fecha.<\/p>\n\n\n\n<p>En representaci\u00f3n del alcalde de Evian, <strong>Rodolphe Barbaroux<\/strong> habl\u00f3 al p\u00fablico sobre la <a href=\"https:\/\/ville-evian.fr\/fr\/ma-ville\/instances-municipales\/objectifs-developpement-durable\" target=\"_blank\" rel=\"noreferrer noopener\">trabajos realizados por la ciudad de Evian para aplicar los Objetivos de Desarrollo Sostenible<\/a>una prioridad para la ciudad. Se han puesto en marcha varias iniciativas a nivel municipal en favor de los derechos de la mujer (precariedad menstrual), el derecho a la alimentaci\u00f3n (frigor\u00edficos colectivos) y la gesti\u00f3n de residuos. Insisti\u00f3 en que todos los ODS deben coincidir con los derechos humanos y las iniciativas puestas en marcha por la ciudad de Evian van en esa direcci\u00f3n.<\/p>\n\n\n\n<p><strong>Nargiz Arupova<\/strong> de <a href=\"https:\/\/www.upr-info.org\/en\" target=\"_blank\" rel=\"noreferrer noopener\">Informaci\u00f3n de la UPR<\/a>La Relatora Especial de la ONU sobre la situaci\u00f3n de los derechos humanos y las libertades fundamentales en \u00c1frica, socia de la coalici\u00f3n para los GLR en el EPU, se\u00f1al\u00f3 que en el dise\u00f1o de sus estrategias para aplicar las recomendaciones del EPU, la sociedad civil se dirigi\u00f3 cada vez m\u00e1s a menudo a los GLR, que se encuentran ahora entre sus principales interlocutores, ya sea como destinatarios de las recomendaciones del EPU o como socios para su aplicaci\u00f3n. Tambi\u00e9n se refiri\u00f3 a un n\u00famero creciente de iniciativas del EPU en las que participan los GLR, ya se trate de buenas pr\u00e1cticas a nivel local o regional en la aplicaci\u00f3n de las recomendaciones del EPU o de la <a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/2021-11\/ItalyMidTermReview3-annex.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Anexo al informe nacional de Italia para el EPU<\/a> en referencia a la labor en materia de derechos humanos realizada por las autoridades subnacionales.<\/p>\n\n\n\n<p>El Representante argentino ante la ONU, Embajador <strong>Federico Villegas, <\/strong>habl\u00f3 de su experiencia personal pasada, relacionada con la aplicaci\u00f3n de la Declaraci\u00f3n y el Programa de Acci\u00f3n de Durban de las Naciones Unidas (DDPA), un importante instrumento de la ONU para combatir el racismo y la discriminaci\u00f3n adoptado en 2002. Se elabor\u00f3 un plan nacional para aplicar la DDPA en Argentina y el Embajador Villegas afirm\u00f3 que \"<em>habr\u00eda sido imposible aplicar la DDPA, si no hubi\u00e9ramos trabajado con el nivel local, para eliminar todas las normativas discriminatorias<\/em>\".<\/p>\n\n\n\n<p>El Centro de Ciudades de Ginebra seguir\u00e1 trabajando en el EPU y en la necesidad de que el mecanismo incluya mejor a los GLR, que son cruciales para aplicar las recomendaciones aceptadas del EPU y, en general, para aplicar los derechos humanos sobre el terreno.
